The ECHR has made a proposal to the Government of Lithuania to seek an amicable settlement with the petitioner. Failing to do so, the Government will have 6 weeks to respond to the questions put to the parties to the proceedings.
The petitioner claims to have been transferred to a secret CIA detention facility in Lithuania to be held there from 2005 to 25 March 2006, when the CIA detention facility was allegedly closed down due to the inability to provide principled healthcare for the detainees.
The petitioner, Al-Hawsawi, had also lodged a complaint with the ECHR against Poland regarding the alleged detention in a CIA prison in that country. However, the declassification of more CIA documents revealed that the petitioner was actually held in detention in Afghanistan at that time. The case was removed the ECHR case list.
