Under the adopted provisions, all participants of a public information producer (disseminator), regardless of the number of shares or the amount of assets held by them will have an obligation to declare the data. Under the currently effective law, only participants of a public information producer (disseminator), who have the right of ownership to at least 10% of all the shares or assets of the public information producers (disseminators), are required to act in this manner.
The Information System on Public Information Producers and Disseminators will be formed on the basis data stored in the Register of Legal Entities, the Information System on Participants of Legal Entities (JADIS), the Licence Information System (LIS), and other state registers and information systems.
The Information System will provide the following additional data relating to public information producers (disseminators): the name, type and category of the public media entity controlled by them; the first and the last name of the person responsible for the content distributed by the public media entity, when the person responsible for the content is other than the manager of the legal entity; information concerning grave professional misconduct; information about public information producers/disseminators, who do not comply with the rules of professional ethics; information about the revenue of public information producers/disseminators gained from political advertising and funds received on the basis of a transaction or an administrative act, the source of which is the state or municipal budget or other foundation established by the state or municipality, or a state or municipal undertaking.
The Explanatory Note accompanying the document notes that since majority of data, which is provided by public information producers and/or disseminators, is collected in state registers and information systems, public information producers and disseminators will not be required to additionally declare the data, because it will be provided to the Information System on Public Information Producers and Disseminators from the aforementioned state registers and information systems.
The new arrangements will enter into force on 1 November 2019.
