UAB Lukoil Baltija is a Russian capital energy concern, coordinating activities of Lukoil group companies in the Baltic countries.
The inquiry determined that UAB Lukoil Baltija made a joint arrangement with UAB Baltic Petroleum and took over control of 15 petrol stations in December 2003, and one more petrol station in June 2008. This way UAB Lukoil Baltija gained control over the petrol stations and by conducting concentration without authorisation from the Competition Council breached the Law on Competition.
In addition to the fine, the company was obliged to eliminate deficiencies. This can be done either by terminating the concentration or by addressing the Competition Council which would then carry out a thorough investigation and decide either to allow or disallow the concentration.
The Law on Competition stipulates that a fine of up to 10% of a company's total income may be imposed. The fine imposed on UAB Lukoil Baltija amounts to 0.47% of its total income in 2012.
